Terms of Service

These terms are the agreement between you and the developer of OMGains for your use of the app. By using OMGains you accept them. If you do not, please do not use the app.
Who may use OMGains
You must be at least 13 years old, and old enough in your country to agree to these terms on your own. If you are under 18, use OMGains only with the involvement of a parent or guardian. Training and nutrition decisions made through this app are yours and theirs, not ours.
Use of the app
OMGains is licensed to you for personal, non-commercial use to plan and track your own training and eating. You may not resell it, rent it out, or make its paid features available to people who have not paid for them.
Your account
Most of OMGains needs no account at all. Signing in with Apple or Google is required only for cloud backup, and for keeping AI credits across a reinstall or a new phone. Keep control of the Apple or Google account you sign in with: whoever can sign in with it can reach your backup and your subscription. You can delete your account whenever you like, from the Cloud backup section of Settings. It goes immediately, along with your backup and any unspent AI credits, and it cannot be undone. Everything on your phone stays where it is, and deleting your account does not cancel a subscription.
The free plan
The free plan currently holds three workouts, five recipes and one grocery cart, shows the last 90 days in the charts and calendar, and includes three free generations in each of the two AI builders. Nothing is ever hidden or deleted by these limits: everything you have made stays, and everything you have logged keeps being recorded. We may change these limits, and the app always shows the ones that apply to you.
OMGains Pro
OMGains Pro is an auto-renewing subscription sold through the Apple App Store or Google Play. The price and the length of the period are shown before you buy, in your local currency. Payment is charged to your store account at confirmation of purchase. It renews automatically for the same period unless you cancel at least 24 hours before the current period ends, and your account is charged for the renewal within 24 hours of the end of the period. Manage or cancel your subscription in your store account settings. Uninstalling the app does not cancel a subscription.
Free trials
Where the store offers an introductory free trial, it converts to a paid subscription automatically at the end of the trial unless you cancel at least 24 hours before it ends. The app schedules a reminder on your device before that happens, but that reminder is a courtesy and not a condition: it is your responsibility to cancel in time.
AI credit packs
AI credits are a one-off purchase, not a subscription. One credit is one generation from either builder. They are used only after your free generations are gone, they do not expire, and a subscription covers generations without spending them. Credits are consumable: they cannot be restored by your store once bought, they cannot be transferred or exchanged for money, and they unlock the AI builders only, not the rest of Pro. Credits belong to the OMGains user that bought them. If you buy credits without signing in and then reinstall the app or move to another phone, that user is gone and the credits go with it, which is why the app asks you to sign in to keep them.
Generation limits
AI generation costs money to run, so it carries limits. On Pro that is currently 15 generations per rolling 24 hours and 50 per rolling 30 days, shared across both builders, and the app states the current figures. We may adjust these limits, and we may pause or withdraw access where use is automated, resold, or clearly abusive.
Cancellation and refunds
You can cancel at any time in your store account settings, and you keep Pro until the end of the period you have already paid for. Purchases are made with Apple or Google, not with us, so refunds are theirs to give under their own policies. Nothing here limits rights you have under the consumer law where you live.
Price changes
Prices may change. A change to the price of a subscription you already hold takes effect only for periods after you have been notified by the store, in the way that store requires, and you can cancel before it applies.
AI features
The AI workout and recipe builders produce suggestions written by a language model. They can be wrong, incomplete, or unsuitable for you. Suggested weights, exercises, calorie figures, ingredient quantities and ingredient flags are starting points for your own judgement, not instructions. You decide what is safe and appropriate for you, and you check anything that affects your health. Do not rely on the ingredient flags to keep you safe from an allergen: they are produced by reading ingredient names and can miss things. Always read the label on the food you buy. We do not guarantee that any two generations differ, that a generation will succeed, or that the feature will remain available in its current form.
No medical advice
OMGains is not a medical device. Everything in it, including the BMI calculator, weight and progress statistics, and anything produced by the AI features, is general information only and is not a substitute for advice from a qualified healthcare provider. Consult a professional before starting any new training or nutrition program, and stop if something hurts.
Your content
Your workouts, recipes, notes, photos and videos are yours. We claim no ownership of them. Almost all of it never leaves your device; the parts that do are set out in the Privacy policy. You are responsible for what you put in the app, including having the right to use any photo or video you add.
Acceptable use
Do not attempt to reach our servers other than through the app, to work around the free plan limits or the generation limits, to mint identities or devices in order to collect more free generations, or to interfere with the service for anyone else. We may suspend access where any of this happens.
Your data and backups
Your data is stored on your device. Cloud backup, when you have Pro and switch it on, covers your workouts, recipes, grocery carts and folders, along with the pictures and videos attached to them. Progress photos, your profile picture, training history, weight log and settings are not backed up and exist only on your phone. Very large files are skipped, and the app tells you when that happens. You are responsible for keeping the device you rely on. We are not responsible for data lost through device failure, uninstallation, an operating system restore, or use of Erase all data.
Availability
Features may change, and the AI builders, cloud backup and purchasing all depend on services outside our control and on your connection. We do our best to keep them running and cannot promise they will always be available.
Third-party services
Some features rely on third parties: AI generation from Anthropic, recipe photographs from fal.ai, subscription and purchase state from RevenueCat, hosting from Supabase, crash reporting from Sentry, and sign-in and payment from Apple and Google. Your use of those features is also subject to those providers’ terms, and we are not responsible for the availability or accuracy of what they return. Ingredient names and pictures are bundled with the app and involve no service at all. See the Privacy policy for what is sent to whom.
Ending this agreement
You can end it at any time by deleting the app, and by cancelling any subscription in your store account. We may suspend or end your access if you breach these terms, and we will tell you why where we can.
Warranty disclaimer
To the extent the law allows, the app is provided “as is” and without warranty of any kind, express or implied, including fitness for a particular purpose, uninterrupted availability, or the accuracy of anything it produces.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential loss, for lost data, or for injury or ill health arising from training or eating decisions you made using the app. Where liability cannot be excluded, it is limited to the amount you paid for OMGains in the twelve months before the claim.
Australian consumers
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded by agreement. Where a consumer guarantee applies and the failure is not major, our liability may be limited to resupplying the service or paying the cost of having it resupplied.
Governing law
These terms are governed by the laws of Australia, and disputes will be heard in the courts of Australia. If you are a consumer elsewhere, this does not deprive you of the protection of the mandatory laws of the country you live in.
Changes to these terms
These terms may be updated from time to time. The date at the top changes when they do, and the updated version appears both in the app and on this page. Continued use of the app after a change means you accept the updated terms.
